These Terms of Service govern the use of www.wanderingsolco.com and purchases made from Wandering Sol Pty Ltd (ABN 46 630 407 582), trading as Wandering Sol. In these terms, “Wandering Sol”, “we”, “us” and “our” refer to Wandering Sol Pty Ltd.
By using this website or placing an order, you agree to these terms and the policies linked from them. If you do not agree, you should not use the website or place an order.
1. Online-store use
You must use this website only for lawful purposes. You must not interfere with the website’s security or operation, introduce malicious code, attempt unauthorised access, or use the website in a way that infringes another person’s rights.
You must provide accurate and current information when placing an order or creating an account. You are responsible for keeping account credentials secure.
2. Products and descriptions
We take reasonable care to describe and photograph products accurately. Colours and textures may appear differently on different screens. Natural materials and waxed canvas may show variations that form part of their character rather than being faults.
Any known imperfection in an Archive or Imperfect item will be disclosed before purchase where reasonably practicable. Disclosure of one imperfection does not remove rights concerning a different, undisclosed problem.
Product descriptions, prices and availability may be updated before an order is accepted. Nothing in these terms limits consumer guarantees that a product must be of acceptable quality, fit for an applicable disclosed purpose and match its description or sample.
3. Prices and payment
Prices are displayed in the currency selected for the customer’s market. Australian prices include GST where applicable. Shipping charges, duties and taxes are displayed or described before checkout where reasonably possible.
Payment is taken when the order is placed, including for pre-orders. Available payment methods are shown at checkout.
4. Orders
An order is an offer to purchase. We may decline or cancel an order where payment cannot be authorised, stock cannot be supplied, an obvious pricing or product error has occurred, or we reasonably suspect fraud or unauthorised activity.
If we cancel an order after payment, the affected amount will be refunded to the original payment method. We will not cancel an accepted order merely to avoid an applicable consumer guarantee or other legal obligation.
5. Pre-orders
Pre-order products are clearly identified before checkout and include an expected dispatch date. Full payment is taken at checkout.
Orders containing both in-stock and pre-order items are held and dispatched together. Customers who would like available items dispatched sooner should place separate orders.
If an unexpected delay occurs, we will provide an updated timeframe. If the customer does not accept the revised timeframe, they may cancel the affected pre-order for a full refund before dispatch.
6. Shipping
Processing times, delivery options, pre-order arrangements and international-shipping information are governed by our Shipping Policy. Available international destinations and rates are shown at checkout.
International duties, taxes and destination fees are the customer’s responsibility unless collected at checkout.
7. Returns, refunds and consumer rights
Change-of-mind returns and remedies for faulty, damaged, incorrect or misdescribed products are governed by our Refund and Returns Policy.
Consumer guarantees under Australian Consumer Law apply automatically and cannot be excluded by these terms. Nothing in these terms limits a right or remedy that cannot lawfully be excluded.
8. Promotions and discount codes
Promotions and discount codes are subject to the eligibility, expiry and combination conditions stated with the offer. A promotion may be limited to selected full-priced products and may exclude gift cards, sale items, Archive products and Imperfects.
Unless expressly stated otherwise, discount codes cannot be combined. Applying a discount does not remove consumer rights under Australian Consumer Law.
9. Gift cards
Gift cards are subject to the conditions displayed when purchased and any applicable law. Gift cards are excluded from the commercial change-of-mind policy but remain subject to rights that cannot lawfully be excluded.
10. Intellectual property
The Wandering Sol name, branding, photographs, product designs, written content and other website material are owned by or licensed to Wandering Sol. They must not be reproduced, distributed or commercially exploited without prior written permission, except where permitted by law.
11. Reviews and submitted content
If you submit a review, image or other content, you confirm that it is accurate, lawful and does not infringe another person’s rights. You grant Wandering Sol a non-exclusive licence to display and use that content for operating and promoting the business.
We may decline or remove content that is unlawful, misleading, abusive, irrelevant or infringes another person’s rights. We will not suppress a genuine review merely because it is critical.
12. Third-party services and links
The website may use or link to third-party services such as Shopify, payment providers, delivery carriers, review platforms and social-media services. Those services may have their own terms and privacy practices.
We are not responsible for independent third-party websites, but this clause does not limit responsibility that cannot lawfully be excluded.
13. Website availability
We may maintain, update or temporarily suspend the website. We do not guarantee uninterrupted access, but we will take reasonable steps to operate the store accurately and securely.
14. Liability
To the maximum extent permitted by law, Wandering Sol is not liable for losses that are not reasonably foreseeable or are caused by misuse of a product, unauthorised use of the website, or events outside our reasonable control.
This limitation does not apply where liability cannot lawfully be excluded or limited, including applicable consumer guarantees and remedies under Australian Consumer Law.
15. Privacy
Personal information is handled in accordance with our Privacy Policy. By providing personal information, you confirm that the information is accurate and that you are authorised to provide it.
16. Changes to these terms
We may update these terms by publishing a revised version with a new effective date. Updated terms apply to future website use and future purchases.
Purchases made before an update retain any applicable commitments or express promises presented when those purchases occurred, together with rights available under law.
17. Governing law
These terms are governed by the laws of New South Wales, Australia. Nothing in this clause prevents a customer from exercising a right available under applicable consumer law.
